Terms and Conditions for AgapePress® Daily Schedule
  1. If you choose to use the AgapePress Daily Schedule ("the Service"), you will be agreeing to abide by all the terms and conditions of this Agreement between you and the AgapePress division of the American Family Association, Inc. ("AgapePress").
  2. AgapePress may change, add or remove portions of this Agreement at any time, but if it does so, it will post such changes on the Service, or send them to you via e-mail. AgapePress may change, suspend or discontinue any aspect of the Service at any time, including the availability of any Service feature, database, or content. AgapePress may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability, other than to refund any unused portion of your subscription fee.
  3. You may publish, in whole or in part, the contents of the Service provided that you credit AgapePress as the source. All materials published on the Service ("the Content") are protected by copyright, and owned or controlled by AgapePress or the party credited as provider of the content.
  4. AgapePress shall not be liable for delays, inaccuracies, errors or omissions in the Content or in the transmission or delivery of all or any part of the Service, or for any damages arising therefrom. THE SERVICE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OF FITNESS FOR PARTICULAR PURPOSE. YOU HEREBY ACKNOWLEDGE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK.
  5. You acknowledge that any submissions you make to the Service ("Submissions") may be edited, modified, published, transmitted, and displayed by AgapePress and you waive any rights you may have in having material altered or changed in a manner not agreeable to you.
  6. You agree that you will not upload to or distribute or otherwise publish Submissions that are libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal. You agree that you will not upload repetitive messages, meaningless messages or "spam." You are solely responsible for your submissions. You warrant that no material submitted through your account will violate, plagiarize, or infringe upon the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights. You warrant that no material submitted through your account will contain libelous or otherwise unlawful material, and that you have the capacity to contract. You hereby agree to indemnify, defend and hold harmless AgapePress and the American Family Association, Inc., from and against any liability and costs, including reasonable attorneys’ fees incurred in connection with any claim arising out of any breach of this Agreement by you or any user of your account. AgapePress reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.
  7. As part of the subscription process, you will give us certain information, all of which must be accurate and up to date. A portion of that information will be your e-mail address, which will be automatically added to a mail-server list used for distributing the Content. You may not select or use an e-mail address of another person with the intent to impersonate that person, or use an e-mail address in which another person has rights without such person’s authorization. You shall be responsible for maintaining the confidentiality of your e-mail. You shall promptly notify AgapePress of any known or suspected unauthorized use of the Content.
  8. Upon notice, communicated by e-mail, telephone or in writing, either you or AgapePress may terminate this Agreement as of the following month. You will not owe any more fees after you give notice to terminate. For annual subscribers, AgapePress will refund any pre-paid fees for any entire unused months.
  9. The Service is published every weekday (Monday - Friday), with the following exceptions: New Year's Day (January 1), Good Friday (Friday before Easter), Memorial Day (last Monday in May), Independence Day (July 4), Labor Day (first Monday in September), Thanksgiving (fourth Thursday in November), and Christmas (December 25). You will be informed via e-mail at least one week in advance of any other non-publishing day.
